Betty asks…

Auto accident at work, reported to supervisor but no claim was filed, help!?

I had an auto accident while on work hours. No claim was filed, no one told me to file a claim that day. They said maybe my auto would cover it. I did see a doctor the following morning. It’s been about three weeks and I’ve been seeing a doctor and am now in physical therapy. Should I pursue the worman’s comp claim or is it too late? Is it my responsibility or my employers?

admin answers:

~~You need to tell your employer you need a form now. They were in the wrong not giving it to you when you first reported it. If they still hesitate, then ask for the number to their WC carrier, and file directly with them. If they still refuse, contact you local labor board for further help. What they are doing is illegal.~~

James asks…

nasty remarks from colleagues after reporting work related accident. bad fall icy condition?

reported an accident (wooden board concealed by snow, i slipped on)to senior manager but other managers made nasty remarks regarding the fall, I continued work for a further two days. initially felt aches but progressively got worse on last shift. accident report has been noted. Its funny that this company spends thousands every year on promoting safeworking, policy after policy yet failed to monitor the icy conditions at work.walkways. paths not even gritted. What are my chances of making a claim against employer? if a claim is made how would this affect my future with employer? any advice, comments welcome.thank you for reading

By law they HAVE to pay medical and they CANNOT fire you for it. If they dont pay for it they you can sue them. And if they fire you for it you can sue them. I slipped on ice and injured my knee (tore mcl completely off the bone) and they claimed that they didnt have workers comp. So i threatened to get a lawyer and they said no we will pay for it. They HAVE TO by law. Dont be afraid of them. Right now you have them by the nuts.

Sandra asks…

Can someone get in trouble with the law for filing an accident report at work and it’s false/does not match?

Just wondering, can someone get in trouble with the law if a person filed an accident report at work and the report was false or did not match up? Like can that person get arrested, fined, etc. ?

Thank you.

admin answers:

If you did so intentionally and did not correct the reort right away when you found out about the mistake then yes. Such conduct is fraud. In fact it is “insurance fraud” which is punished extra hard in a lot of states.
